Martina Flor Academy is operated by Big Ampersand GmbH, a company registered in Germany (hereinafter referred to as “we”, “us”, or “our”).

We provide educational content, programs, services, and digital products through our websites and platforms, including but not limited to:

These are collectively referred to as the “Platforms.”

2. Scope & Acceptance

By accessing or purchasing from our Platforms, you agree to these Terms & Conditions.

You confirm that:

  • You are at least 18 years old, or
  • You have legal permission from a parent or guardian

If you do not agree, you may not use our services.

3. Services

We provide:

  • Online courses and programs
  • Membership access
  • Digital content and resources
  • Live and recorded sessions
  • Mentoring services

Access to services is granted upon purchase. Access duration varies depending on the product and will be specified at the time of purchase.

Access to certain services may be conditional upon full or continued payment.

4. Right of Withdrawal (EU Consumers)

If you are a consumer residing in the European Union, you have a statutory 14-day right of withdrawal.

Access to digital content and online programs is provided immediately after purchase.

Your statutory right of withdrawal remains unaffected, regardless of whether you have accessed or used the content during this period.

You may exercise your right of withdrawal within 14 days of purchase in accordance with applicable law.

Independent of this legal framework, specific refund policies apply to individual products, as outlined below.

5. Product-Specific Refund Policies

The following policies apply in addition to your statutory right of withdrawal and do not limit any rights you may have under applicable law.

5.1 The Lettering Seminar

  • You may request a refund within 14 days of purchase
  • After 14 days, no refunds will be issued
  • If physical materials were provided, they must be returned at your own cost

5.2 Big Ampersand Membership

Yearly Plans

  • 14-day money-back guarantee from initial purchase

Renewals

  • 48-hour grace period after renewal to request cancellation and refund

After these periods, no refunds apply.

5.3 1:1 Mentoring Sessions

Validity

  • Sessions must be used within 12 months

Rescheduling

  • Minimum 24-hour notice required
  • Missed sessions may be forfeited

We reserve the right to limit rescheduling in cases of repeated changes.

Due to the personalized nature of the service, refunds are generally not provided outside of your statutory right of withdrawal.

5.4 Other Courses & Products

Refund eligibility depends on the specific product and will be clearly stated at the time of purchase.

5.5 Live / In-Person Workshops

  • More than 30 days before start: full refund
  • 30 days or less: non-refundable

Instead, a credit will be issued:

  • usable for another workshop or program
  • valid for 6 months
  • non-transferable and not redeemable for cash


These policies apply in addition to and do not limit your statutory rights.

6. Use of Content & License

All materials provided are protected by copyright.

You are granted a personal, non-exclusive, non-transferable license to use the content.

You may not:

  • Copy, reproduce, or distribute materials
  • Share access with others
  • Use content for commercial purposes

Any unauthorized use may result in termination of access and further legal action..

7. User Conduct

You agree to use our Platforms responsibly and legally.

You may not:

  • Violate any laws
  • Disrupt or interfere with the Platforms
  • Attempt unauthorized access
  • Share harmful, offensive, or illegal content
  • Use the Platforms for spam or commercial solicitation

We reserve the right to restrict or terminate access in case of violations.

8. User-Submitted Content

If you submit content (e.g. comments, feedback, images):

  • You retain ownership of your content
  • You grant us a non-exclusive, worldwide, royalty-free license to use it for:
  • educational purposes
  • marketing
  • platform improvement

We will not claim exclusive ownership of your work.

9. Platform Availability

We strive to provide uninterrupted access but cannot guarantee that the Platforms will always be available or error-free.

We may:

  • update or modify content
  • temporarily suspend access for maintenance

We do not guarantee uninterrupted or permanent availability of any specific content or service.

10. Limitation of Liability

We are liable without limitation for:

  • intent and gross negligence
  • injury to life, body, or health

For minor negligence, we are only liable for breaches of essential contractual obligations.

We are not liable for:

  • indirect damages
  • loss of profits
  • business interruption

To the extent permitted by law.

11. Termination

We may suspend or terminate access to our Platforms for justified reasons, including if:

  • you violate these Terms
  • misuse the services

We are not responsible for their content or practices.

13. Changes to These Terms

The version in effect at the time of your use or purchase applies.

14. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany.

If you are a consumer, mandatory consumer protection laws in your country of residence remain unaffected.

These Terms are provided in English. In case of discrepancies between translations, the English version shall prevail.
